AMONG OTHER ACTIVITIES, CLOUD CLINIC’S SERVICES ENABLE COORDINATION AND COMMUNICATION WITH A HEALTH CARE PROVIDER. IT DOES NOT REPLACE YOUR RELATIONSHIP WITH ANY PHYSICIAN. THESE SERVICES MIGHT NOT BE APPROPRIATE FOR ALL MEDICAL CONDITIONS OR CONCERNS. IF YOU HAVE A MEDICAL EMERGENCY, IMMEDIATELY CALL YOUR DOCTOR OR DIAL 995.
1. INTRODUCTION
Cloud Clinic Pte. Ltd. (collectively, “Cloud Clinic,” “we,” “us,” or “our”) own and operate the websites located at www.thesire.sg (collectively, the “Websites,” and collectively with any affiliated mobile application (“App”), the “Sites”). The Sites facilitate “Services” including: (i) health and wellness Content; (ii) pharmacy services; (iii) gathering and retention of health records for use in consultations; (iv) administrative support for scheduling and payment; and (vi) telecommunications support for direct access to healthcare providers.
By accessing the Sites, you agree to be bound by these Terms of Use and our Privacy Policy. Cloud Clinic reserves the right to review or remove any part of these Terms at its sole discretion at any time.
2. AVAILABILITY
Certain Services are currently only available to individuals physically located in Singapore.
3. ELIGIBILITY
To qualify for the Services:
- You must be age 18 or over.
- You must be located in Singapore.
You must provide valid identification (NRIC/FIN) as required by the Healthcare Services Act (HCSA). Satisfying these requirements does not guarantee you will receive Services; Cloud Clinic reserves the right to change requirements without prior notice.
4. REQUIREMENTS FOR USE
You must have compatible computing devices and Internet access. You are responsible for any fees or charges from your Internet or mobile service provider.
5. SPECIAL CONSENT TO TELE-HEALTH SERVICES
Telemedicine involves delivery of healthcare via electronic communications. It includes the transmission of medical records and interactions via audio/video.
- Security: We incorporate network security protocols to protect data integrity.
- Risks: You acknowledge the risks of telemedicine, including potential data breaches or technical failures.
HCSA Compliance: Under the Healthcare Services Act (Remote Care) Regulations, if a provider deems your condition “unsuitable for telehealth,” they are legally required to refer you to an in-person facility.
6. PRIVACY POLICY
Cloud Clinic understands the importance of confidentiality. Please see our Privacy Policy for a description of how we collect and use your data. Your data may also be contributed to the National Electronic Health Record (NEHR) as required by the Health Information Act 2026..
7. YOUR RELATIONSHIP WITH CLOUD CLINIC
Cloud Clinic is a healthcare provider, but these resources are not a substitute for in-person care in all cases. You agree to monitor all communications (disclosures, notices, reports) sent by us and will not hold Cloud Clinic liable for loss resulting from failure to read them or comply with treatment recommendations.
8. CONSULTATION SERVICE
A provider consulting via the Sites may not have the benefit of a “hands-on” physical examination. You agree to assume the risk of these limitations. Any diagnosis received is limited and, in some cases, provisional.
9. SITE CONTENT
All content and/or communication on the sites should not be solely considered as medical advice. You are advised to speak to your local healthcare provider with regards to your personal health and healthcare needs.
10. REGISTRATION AND USER ACCOUNTS
You must register to become a “Secure User.” You agree to provide accurate, complete information. You must notify us immediately at info@thesire.sg of any breach of security. Cloud Clinic disclaims liability for losses arising from your failure to keep your password confidential.
11. ‘JAILBREAKING’ THE MOBILE OPERATING SYSTEM
The App is intended for use only on unmodified manufacturer-approved operating systems. Using a “jailbroken” or modified device is a material breach of these Terms as it compromises the security of your protected health information.
12. ACCESS RIGHTS AND PROHIBITED USE
We grant you a limited, revocable right to use the Sites in Singapore for personal use. You agree not to:
- Impersonate any person or misrepresent your affiliation.
- Reverse engineer or decompile any software.
- Distribute viruses or harmful code.
Record Sessions: You are strictly prohibited from recording audio or video of consultations without express written permission.
13. OWNERSHIP OF INFORMATION SUBMITTED VIA THE SITES
With the exception of personal data governed by the PDPA, any questions, comments, or suggestions you submit will be treated as non-confidential and become the property of Cloud Clinic.
14. OWNERSHIP OF SITE CONTENT
Cloud Clinic is the sole and exclusive owner of all Site content, software, text, and design. You are not permitted to reproduce, modify, or exploit any material on the Sites without express permission.
15. TRADEMARKS
All logos and service marks are the property of Cloud Clinic. No license to use these Marks is granted under these Terms.
16. LINKS TO THIRD-PARTY HYPERLINKS AND WEBSITES
We are not responsible for the content of Linked Sites. Your use of third-party links is at your own risk.
17. TERMINATION
These Terms remain in effect as long as you use the Sites. Cloud Clinic may terminate or suspend your access for any reason at any time. Surviving provisions include Liability, Indemnification, and Governing Law.
18. DISCLAIMER OF WARRANTIES
The sites are provided on an “as is” and “as available” basis. We disclaim all warranties, including merchantability, fitness for a particular purpose, and freedom from viruses. We do not guarantee uninterrupted or error-free service.
19. LIMITATION OF LIABILITY
To the fullest extent of applicable law, cloud clinic and its related persons shall not be liable for any indirect, incidental, or consequential damages, including loss of revenue, personal injury, or emotional distress arising out of your use of the sites.
20. INDEMNIFICATION
You agree to indemnify and hold Cloud Clinic harmless from any third-party claims arising from your fraud, violation of law, or breach of these Terms.
21. MODIFICATIONS TO THE SITES
Cloud Clinic reserves the right to modify or discontinue the Sites or Services at any time with or without notice.
22. PHARMACY SERVICES
Cloud Clinic coordinates the shipment of prescriptions. You consent to the disclosure of your health records to our fulfillment partners to facilitate these services.
23. PACKAGING AND FULFILLMENT RESTRICTIONS
You acknowledge that medications may not be shipped in child-resistant packaging. You are responsible for keeping medication out of reach of children and ensuring proper storage upon delivery.
24. PAYMENT
You agree to pay all fees due for Services. You authorize us or our third-party processors to charge your payment method. Cloud Clinic has no obligation to provide Services until full payment is verified.
25. GOVERNING LAW; DISPUTE RESOLUTION; VENUE
These Terms and your use of the Sites shall be governed by the Laws of Singapore. Any dispute arising under these Terms shall be resolved exclusively by the Courts of Singapore. (Provisions regarding US-based Arbitration have been removed for local compliance).
26. NO WAIVER
Failure by Cloud Clinic to assert any right does not constitute a waiver of that right.
27. NO AGENCY RELATIONSHIP
No partnership, joint venture, or employment relationship is created between you and Cloud Clinic by these Terms.
28. REMEDIES
Violation of these Terms causes irreparable harm. Cloud Clinic is entitled to seek injunctive or equitable relief in addition to monetary damages.
29. ASSIGNMENT
You may not assign your rights under these Terms. Cloud Clinic may transfer its rights and obligations in the event of a merger or sale.
30. COPYRIGHT COMPLIANCE
We respond to notices of alleged copyright infringement in accordance with the Singapore Copyright Act 2021.
